The legal system of ancient Greece
Legislation and judicial system:
In Athens, law developed from ancient oral traditions to written laws. The first written laws were created by the Dragon in 621 B.C. These laws were known for their brutality.
Later, in the 6th century BC, Solon reformed the legal system, making it fairer and more accessible. He divided the population into four classes based on income, which affected their rights and responsibilities.
The judicial system of Athens included people's courts (dicasteries) where citizens could serve as judges. The Areiopagus, the council of elders, also played an important role in criminal cases.
Civil and criminal law:
Civil law regulated property, obligations, family relations, and inheritance. There were strict rules about land ownership, marriage, and divorce.
Criminal law included penalties for theft, murder, insult, and other offenses. Punishments ranged from fines to the death penalty.
System of government and laws:
Sparta had a unique system of government based on the laws of Lycurgus. The main purpose of these laws was to maintain military strength and discipline.
The laws of Sparta regulated the lives of citizens from an early age, including education, military training, and social obligations.
Military law:
There was strict military discipline in Sparta. Any acts of insubordination or cowardice were punished severely.
Land was owned by the state and distributed among citizens to maintain equality and prevent the accumulation of wealth.
Principle of legality:
In the Greek polis, the principle of the rule of law was fundamental. Laws had to be obeyed by all citizens, including rulers.
Public and Private Law:
Greek law was divided into public law (regulating relations between the state and citizens) and private law (regulating relations between private individuals).
Trials:
Trials were often held in public. Citizens had the right of defense and could hire lawyers or defend themselves.
Legal education:
Educated Greeks, especially in Athens, studied law and rhetoric, which helped them in legal disputes and public life.
