26 Jul 2015, Zero tolerance and detention by ABF for failure of character test under s501

Australian Border Force (ABF) has adopted a zero tolerance policy in relation to visa holders or visa applicants who fail the character test at s501 of the Migration Act.

It appears that these matters will be referred to the VACCU (Victorian Assessment of Criminal Character Unit) for further consideration.

Applicants should be aware that should that action arise in connection with a BV application and the applicant is an unlawful non-citizen at time of lodging the application, they will be detained pending a decision by VACCU.

Detention will apply irrespective of whether or not a valid review application has been made.
