A similar invention has been registered in the Russian Federation since 2018 by Rospatent as a "Wind farm". Taking into account the filing of an application for an invention in October 2018 with the number 2020/05046 to the Turkish Patent Office (Turkpatent) (Internet address: turkpatent.gov.tr), its publication from September 21, 2021 on the territory of Turkey, protection has been granted to the holder of exclusive rights to a wind farm for 20 years. Patent registration number: TR 2020 05046 B. The patent of the Turkish agency contains international classifications of the invention: F03D 3/00 - F03D 9/34, F03D 9/45.
Obtaining a Turkish national patent for an invention has the prospect of developing and creating a real capital construction facility - a wind energy complex on the territory of this country due to the interest of the government and business in the development of alternative energy sources, reducing electricity shortages and infrastructural development of territories.
Turkey remains one of the most attractive jurisdictions for foreign investors and entrepreneurs. It is a transport hub connecting Europe and Asia, where many business benefit programs are available without customs duties and with a zero tax rate. Turkish intellectual property (IP) legislation is closely related to the laws of the European Union and international norms. This provides good opportunities for the protection of IP and patent law in the courts of jurisdiction located in most major cities of the country. Many aspects of legal relations, including the assignment of ownership rights to patent law and copyright, are regulated by the Constitution of the Republic of Turkey, civil, administrative, criminal norms. According to Turkish law, IP protection is also possible under general rules, such as "Unfair Competition Regulations". The owner of intellectual property has every right to apply for a preliminary ban on the termination or prevention of infringing activities, as well as to demand the seizure of infringing goods.
It seems that the patent for an innovative wind energy complex will contribute to the development of both the W.E.T.E.R. project itself and its implementation in a real infrastructure facility.
