The national phase of the patenting of the wind power plant in Brazil
Based on the international application PCT/RU2018/000686, registered by the International Bureau (IB) of the World Intellectual Property Organization (WIPO), the international patenting procedure in the PCT system has been transferred to the national phase of the patenting of the Wind Power Plant in Brazil. Brazil's National Institute of Industrial Property (www.inpi.gov.br) has registered the application of Tiaglin D.V. for the Wind Power Plant under No. BR112020006027-5, filed by a registered patent attorney. In accordance with Law No. 9.279 of 1996 (Industrial Property Law), the Brazilian Patent Office has conducted a formal examination of the application for compliance with the formal requirements. In September 2022, the patent attorney was requested to provide reasoned answers on the description of the invention and its claims and to conduct the examination.
For the substantive examination (which determines whether the invention meets the patentability criteria), the applicant must file a petition with the Office not later than 36 months from the filing date of the application/international application. The examination is carried out 60 days after publication of the application in the Official Gazette.
In case of a positive decision of the examination, registration, publication in the official gazette and granting of the patent for the invention takes place. The state fee for granting the patent shall be paid and the document confirming the payment shall be received by the Office within 60 days after the decision on granting the patent.
