Self-declaration as a basis for MSME registration
According to the Udyam Registration requirements, Udyam Registration can be completed by completing a self-declaration. The following is an excerpt from the relevant notification:
Anyone who wants to start a micro, small, or medium business can use the Udyam Registration portal to file an application based on self-declaration, with no need to upload paperwork, papers, certificates, or proof.”
Following an examination of the Udyam Registration portal's registration process, it was discovered that the list of key activities includes a distinct heading for trading operations, land transportation, and the option to pick 'Others.' As a result, it can be determined that trading, transportation, and other similar activities fall under the category of service enterprise activities and must be registered as an MSME on the Udyam Registration platform.
Requirements for MSME Registration Documents:
The following individuals' Aadhaar numbers will be necessary for MSME registration.
The business's PAN and GSTIN will also be required.
Aadhaar Card Isn't Available:
If a person does not have Aadhaar, he or she can go to MSME-Development Institutes or District Industries Centres (Single Window Systems) with his or her Aadhaar enrolment identity slip or copy of Aadhaar enrolment request, bank photo passbook, voter identity card, passport, or driving license, and the Single Window Systems will help the procedure includes obtaining an Aadhaar number and then proceeding to the Udyam Registration process.
New Investment and Annual Turnover Calculation Criteria:
Calculation of amount for Investment in Plant, Machinery, and Equipment, and Annual Turnover is necessary to assess whether the firm comes within the boundaries of MSME and under which category.
Plants, machinery, and equipment are all examples of plant, machinery, and equipment:
Land, buildings, and furnishings, and fittings are not included in the definition of plant, machinery, and equipment under the Income Tax Rules of 1962. Furthermore, products included in Explanation 1 to Section 7 of the MSME Act 2006 are not included.
All units with the same Goods and Services Tax Identification Number (GSTIN) listed against the same Permanent Account Number (PAN) will be treated as one enterprise, and investment figures for all of these entities will be viewed together, with only the aggregate values used to determine whether the entity is classified as micro, small, or medium.
The prior year's Income Tax Return (ITR) will be used to calculate the investment in plant and machinery or equipment. In the case of a new business with no prior ITR, the investment will be based on the promoter's self-declaration, and this relaxation will terminate after the 31st March of the financial year in which the business files its first ITR.
However, in the event of a new business without an ITR, where the calculation is done on a self-declaration basis, the purchase (invoice) value of a plant, machinery, or equipment, whether purchased new or used, shall be taken into account, excluding Goods and Services Tax (GST).
