BitFlick Exchange aims to provide a convenient and transparent cryptocurrency exchange process. These rules are designed to ensure the safe and comfortable use of our service. By using our services, you agree to comply with the following terms. We respect rights and laws, and your well-being is our priority.
1. Exchange
1.1 User Status: You automatically become a user of the service from the moment you first use our Telegram bot. This means that all operations related to cryptocurrency exchange through the bot are governed by this agreement.
1.2 Processing Time: The average processing time for an exchange on our platform is less than 5 minutes. However, in exceptional cases, this process may take slightly longer, depending on network conditions and transaction specifics. We do our best to minimize delays.
1.3 Cryptocurrency Volatility: Due to the volatility of cryptocurrencies, the exchange rate may change during the exchange process, which may lead to slight differences between the declared and received amounts. This difference can be both positive and negative, depending on market fluctuations. We strive to offer you the most favorable rates at the time of exchange.
1.4 Incorrect Details: The user is fully responsible for the accuracy of the provided details. The service is not liable for any consequences related to the transfer of funds to incorrect addresses or the transfer of an incorrect amount. The user bears full responsibility for the accuracy of the information provided when filling out the application. If the user has provided incorrect or incomplete data, BitFlick Exchange is not liable for any losses incurred by the user due to this error. If it is possible to correct the error, BitFlick Exchange reserves the right to suspend the exchange operation until the problem is fully resolved.
1.5 Liability for Third-Party Actions: BitFlick Exchange is not liable for any losses incurred by the user as a result of unlawful actions of third parties.
1.6 Software/Hardware Failures: BitFlick Exchange is not responsible for malfunctions, errors, or failures in the operation of software and/or hardware due to reasons beyond the control of BitFlick Exchange, as well as any associated losses incurred by the user.
2. Security
2.1 Suspicious Transactions: If funds are detected that violate AML (Anti-Money Laundering) regulations, the service or its partners reserve the right, in exceptional cases, to request identity verification through KYC (Know Your Customer) procedures or, in some cases, return the funds within 48 hours.
Our AML policy aims to detect transactions related to terrorism financing, money laundering, and other illegal activities. If your funds are found to be associated with such violations or the AML risk level of the transaction exceeds the permissible limit, the service reserves the right to:
2.2 Freeze the exchange transaction or user’s funds.
2.3 Independently or with partner tools – request a photo or video of the user holding an identity document.
2.4 Block the user account, suspend all transactions, and provide information to regulatory or law enforcement authorities in the jurisdiction where BitFlick Exchange is registered.
2.5 Withhold the user’s funds until a full investigation is conducted.
2.6 Return digital assets only to the original payment details or transfer them to other details after a full security review by BitFlick Exchange’s security team, provided that the legal origin of the funds is verified.
2.7 Request additional materials and documents from the user regarding the exchange transaction.
3. Confidentiality
3.1 Data Protection: We strictly adhere to our privacy policy and guarantee that your personal information will not be shared with third parties without your consent, except as required by law.
3.2 Data Collection: The service reserves the right to collect additional user data within the framework of applicable laws and the terms of this agreement.
4. Fees and Refunds
4.1 Exchange Fees: The service charges a commission fee during the exchange operation. The commission fee may vary depending on the specified direction, the final exchange amount, and other factors.
4.2 Refunds: After the funds are sent to our details, a refund cannot be made by the service in any way. Refunds are only possible by successfully completing the exchange process. Other refund methods are not provided.
5. Data Collection and Usage
5.1 Collected Data: BitFlick Exchange collects the following data:
- User’s Telegram ID;
- Cryptocurrency wallet address (if provided by the user);
- Exchange history for analysis and quality improvement;
- Other information collected by default through Telegram Mini Apps.
5.2 Purposes of Data Collection:
- Proper execution of exchange operations;
- Statistical analysis to improve the service's performance;
- Ensuring transaction security and preventing fraud.
5.3 Data Sharing: Your data will not be shared with third parties without your explicit consent, except as required by law.
6. Liability
6.1 Source of Funds: The user is responsible for ensuring the legal and legitimate origin of their funds. If illegal activities are detected, the service reserves the right to block access to the bot without full or partial reimbursement of the funds.
6.2 Fraud: If vulnerabilities in the bot are exploited, the service reserves the right to block the user’s account without the possibility of recovery.
6.3 Illegal Activities: Users are prohibited from using the bot for unlawful activities such as money laundering or terrorism financing. The service is not responsible for third-party claims regarding illegal activities committed by users; all liability falls on the violating party.
6.4 User Integrity: By accepting this agreement, the user guarantees that they are the rightful owner of the funds used in their transactions.
6.5 Legal Compliance: By making an exchange, the user agrees to the terms of this agreement and confirms that they are at least 18 years old and have no legal restrictions preventing them from conducting cryptocurrency exchanges in accordance with the laws of their country of residence.
7. Support and Problem Resolution
7.1 Technical Support: If you encounter technical issues or have questions about the exchange, please contact our support team. We promptly address any problems to ensure the smooth operation of the service.
8. Service Rights
8.1 Order Rejection: We reserve the right to refuse service or suspend a user’s account in case of suspected fraud, money laundering, or other violations.
8.2 Policy Changes: BitFlick Exchange reserves the right to amend this agreement without prior notice. Users are responsible for checking updates to the terms and conditions on their own.
8.3 The service reserves the right to suspend transactions and freeze funds in an account if a corresponding request is received from law enforcement authorities.
8.4 In case of a user violating this agreement, the service reserves the right to cancel or suspend transactions and block the user’s account.
9. Force Majeure
9.1 Force Majeure: The operator is released from liability for non-fulfillment of obligations under this Agreement in case of force majeure circumstances, such as natural disasters, wars, riots, strikes, government actions, and other unforeseen situations.
10. Public Offer
10.1 Public Offer: This Agreement is a public offer. The use of BitFlick Exchange bot services is considered full and unconditional acceptance of this agreement.
